BEFORE REGISTERING WITH US, YOU SHOULD CAREFULLY READ THE TERMS PROVIDED ON THE WEBSITE WHICH ARE APPLICABLE TO ALL SERVICES ON THE WEBSITE AND GAME RULES APPLICABLE.

These Terms and Conditions (“Terms”) govern your use of the PokerBaazi website, its connected mobile application (“Platform”) and related online free to play gaming services (“Services”) operated by M/s GetZapped Technologies Limited (referred to as “GetZapped”, “Company”, “We”, “Us” or “Our”).

By accessing or using the Platform, you (“User” “You”, “your” or “their”) agree to be bound by these Terms, the Privacy Policy and Legality (collectively, the “Platform Policies”) which forms a binding legal agreement between You and the Company, on the basis of which You may visit, access, or use the Platform, mobile applications, and Services. We reserve the right to periodically review, update, or otherwise modify any part of the Platform Policies at Our sole and absolute discretion, and accordingly, You are advised to keep Yourself updated on the latest versions of the Platform Policies. We will provide You with notice of any material modification to the Platform Policies, and Your continued access and use of the Services after such notification shall constitute consent to the modified Platform Policies.

The User should read, understand and agree to the Terms which includes those terms and conditions expressly set out below and those incorporated by reference, which You can access by clicking on the relevant link. However, prior to initiating the process of opening an account on the Platform, the User assumes full responsibility to ascertain that they are not situated in a jurisdiction within, or outside India where free-to-play online social games are prohibited or deemed unlawful, and the User is not in breach of any legislation or regulation in force in a given jurisdiction.

DEFINITIONS

“Account” means the User account created on the Platform and maintained with the Company, which enables Users to play Games on the Platform.
“Applicable Law(s)” means all applicable statutes, enactments, laws, ordinances, treaties, conventions, protocols, bye-laws, rules, regulations, guidelines, notifications, notices, and/ or judgments, decrees, injunctions, writs or orders, instructions, decisions of any court or and awards or other requirements or official directives of any governmental authority, in any jurisdiction, as may be applicable to the relevant person.
“Bank Account” means a financial account maintained with a Banking Company or a financial institution and shall include a wallet maintained with any financial entity.
“Banking Company” means a banking company as defined under Applicable Laws.
“Existing User(s)” shall mean all the users registered with Baazi Networks Private Limited on the ‘PokerBaazi’ application and website.
“Game(s)” means the online free-to-play game of Poker offered on the Platform, including its various formats and variations and quick/ practice games.
“Leaderboard” shall mean the performance-based ranking system established by the Platform to record, compare, and display a User’s relative standing based on their participation in eligible Games or tournaments separately.
“Rake” shall mean the predetermined percentage or fixed quantity of Play Chips (defined hereinbelow) deducted by the Platform for the purpose balancing gameplay and regulating the amount of chips available on the Platform. Rake is applied only to Play Chips, has no monetary value, and does not generate any real-world fees, charges, revenue, or economic benefit for the Company.
“Restricted Territories” means any state in India or any jurisdiction, including any such country where online gaming is prohibited under Applicable Laws or permitted only via appropriate license/ registration.
“Reward Points” means non-monetary loyalty points earned through Games, Leaderboards, tournaments, and other non-monetary engagement mechanisms. They are not money or representative of any monetary value, and are not redeemable for cash, currency, refunds, or withdrawals. They may be redeemed solely within the curated Reward Store.
“Reward Store” means the curated store maintained on the Platform operated in partnership with third-parties where the User(s) may redeem Reward Points for curated merchandise, gift cards, vouchers, and other rewards as made available.

PLAY CHIPS

Play Chips are virtual chips made available on the Platform for the purpose of enabling Users to participate in Games, tournaments and other free-to-play formats offered on the Platform. These Play Chips have no cash value, cannot be purchased in exchange of any sort of money, currency or monetary consideration or other stakes, are not redeemable, and cannot be withdrawn or exchanged for money, currency, or any monetary consideration.
It is reiterated that Play Chips cannot be purchased through the Platform or through any other means. the Company does not permit, recognise, or facilitate the purchase, sale, transfer, or exchange of Play Chips, whether for money, goods, services, or any other benefit, inside or outside the Platform.
Permitted methods of obtaining Play Chips (“Permitted Methods”): You may obtain Play Chips exclusively through the following non-monetary modes made available on the Platform from time to time:
1. Daily Claim: You may claim a predetermined quantity of Play Chips once every calendar day subject to the internal daily claim conditions of the Platform.
2. Bonus Chips: You may claim bonus chips once every hour from the time of the last Bonus Chip claim made available on the Platform. For example, if a User claims Bonus Chips at 5:15 p.m., the next Bonus Chips claim shall become available at 6:15 p.m.
3. Tournament Rewards: Play Chips may be awarded as rewards in free-to-play tournaments after achieving the requisite Leaderboard rankings or final positions.
4. Game Leaderboards: Play Chips may be awarded based on User performance or ranking in Games, as deemed fit by the Platform.
5. Advertisement Rewards: Play Chips may be rewarded for voluntarily watching designated rewarded advertisements as made available on the Platform from time to time.
6. Promotional Activities: GetZapped may award Play Chips as part of promotional events, engagement campaigns, onboarding incentives, or other such occasions as a non-monetary reward.
Play Chips may be used solely to enter and participate in Games made available on the Platform. Play Chips cannot be used outside the Platform and do not represent any monetary value.
The Platform will apply a Rake to Play Chips as a method of sinking chips and virtual gameplay management.
You hereby undertake that You shall not transfer or attempt to transfer Play Chips to other Users; exchange, trade, gift, or redeem Play Chips for money, goods, services, or benefits; engage in any activity intended to artificially inflate or manipulate the acquisition or use of Play Chips; obtain Play Chips through any manner other than the Permitted Methods mentioned hereinabove.
The Company may, at its sole discretion and without prior notice adjust the quantities of Play Chips awarded through any mechanism, add, modify, or discontinue methods of obtaining or using Play Chips, or revoke or remove Play Chips obtained in violation of these Terms.

RAKE PERCENTAGE

The Company applies a gameplay balancing mechanism known as Rake, whereby a proportionate percentage of Play Chips is automatically deducted from the final pool of accumulated Play Chips after the end of the Game.
The Rake percentage or amount applicable to any game or tournament may vary depending on the table type, gameplay mode, or design of the game, and may be modified by the Company from time to time at its discretion.
The Rake mechanism is implemented solely for chip-sink and virtual gameplay management, and the deducted Play Chips do not have, and cannot be converted into, any monetary value.
The application of Rake does not constitute a fee, charge, commission, stake, or consideration of any kind. The Company does not receive or realize any monetary or real-world value from Rake, and it does not impact, alter, or relate to any real-money gaming activity.

SERVICES

The Services offered on the Platform are purely in respect of free-to-play versions of Poker. It is hereby clarified that no participation fees, entry fees, deposits, or monetary stakes are accepted, collected, or processed from Users by the Platform under any circumstances. The Platform however does provide for a subscription to the Services being provided under the Platform through Membership (defined hereinbelow).
The Users are strictly prohibited from transferring or attempting to transfer any funds, tokens, or equivalent items of monetary value within or outside the Platform in connection with gameplay or participation.
All forms of monetary collection, wagering, betting, or staking of value between Users are expressly disallowed on the Platform.
The Company does not facilitate, process, or permit any wallet top-ups, cash deposits, or financial transactions in its Services that could constitute an ‘online money game’ under the Promotion and Regulation of Online Gaming Act, 2025 (“PROGA”) or any applicable state law within the jurisdiction of the Republic of India.
Any attempt by a User to circumvent this restriction shall result in immediate suspension or termination of the Account (defined hereinbelow) and forfeiture of any Reward Points , without prejudice to the Company’s rights to take further legal action.

REWARD POINTS AND PRIZE DISTRIBUTION

The Company shall, through Services and by organizing specific free-to-play tournaments, Games, reward top-performing Users based on their performance and position at the end of a particular Game or tournament.
All rewards, prizes, or related honorariums shall be in the form of Reward Points as defined hereinabove, awarded to Users based on their performance and final ranking on the Leaderboard at the conclusion of free-to-play Game or tournament. It is hereby clarified that such Rewards Points are earned in accordance with the Game’s scoring methodology, including but not limited to proportionate Reward Points accrued based on coins generated through Rake or other in-game activity(“Points Pool”), decided at the sole discretion of the Company. The Points Pool shall be distributed among the top-performing Users in descending order of their respective rankings. For the avoidance of doubt, neither the Points Pool, nor the Reward Points are funded through any form of User contribution, entry fee, or stake.
A User’s final position on the Leaderboard at the end of a defined leaderboard cycle determines the Reward Points or Play Chips that the Platform may offer. The Platform may operate multiple independent Leaderboards, including separate Leaderboards for Games and tournaments, each governed by its respective rules and criteria.
Reward Points shall be credited to the User’s in-app wallet upon the conclusion of the Game, tournament or contest period, subject to compliance with these Terms.
It is emphasized that the Rewards cannot be redeemed for real-money, outside of the Platform.
The Company reserves the right to withhold or cancel any Reward Points if it suspects any fraudulent activity, unfair gameplay, or non-compliance with Applicable Laws or Platform Policies.

REWARD STORE

The Platform provides access to a Reward Store where Users may redeem Reward Points.
The Reward Store is operated in association with third-parties and all items provided in the Reward Store are subject to the terms and conditions of such third-party.
The availability of items in the Reward Store and related aspects such as delivery, guarantee, warrantee, as may be applicable are subject to the conditions of the third-party.
Reward Points cannot be exchanged or redeemed for cash, discounts, monetary value, or cash equivalents.
GetZapped or the Platform is not responsible for the quality, fitness, delivery, or fulfilment of third-party reward items; such responsibility lies with the respective third-party.
Reward Store offerings may be changed, discontinued, or updated without notice.

RIGHT TO ACCESS THE SERVICES

Our Platform and Services are not available to anybody under the age of 18 (eighteen) on the day of User Registration through the registration process as defined hereinbelow. We reserve the right to request proof of age at any stage to verify that the declaration of age provided by You at the time of registration is genuine and We may prohibit usage of the Platform or the Services to a person if proof of age is not provided upon request or if the Company suspects that a person using the service is under-age.
The Services are not intended for Users connecting to the Platform from Restricted Territories that state it is illegal to do so as is evidenced in our Legality document. If any person becomes a User of the Platform by giving false information, the liability will be solely on the User and the Company reserves the right to terminate the User's Account without any notice. If the Company finds a User playing on the Platform, being under the age of 18 (eighteen), such Users account(s) will be terminated with immediate effect. Such User shall keep the Company, its affiliates, officers, representatives and agents fully indemnified from such misrepresentation. You accept that the Company will not be liable to take any responsibility for the breach by the User of Applicable Laws.
We reserve the right to terminate Your access and use of the Services when We become aware of or are of the opinion, at Our sole discretion, that Your use and access of the Service(s) is in violation of the Platform Policies.
The Applicable Laws in certain states may prohibit a User from using the Services offered on our Platform. You agree that You are not from the Restricted Territories and You shall refrain from making any false disclosures, declarations and/or representations to Us to circumvent the Applicable Laws and/or regulations of the of the Restricted Territories to participate in any Games. There may be applicable penalties imposed on such a User by the respective State Governments or the Central Government as the case may be. The Company does not accept User requests from people who are residing in these jurisdictions and if a User residing in such jurisdiction becomes a member of the Platform by giving false information, the liability will be solely on the User and the Company reserves the right to terminate the User's Account without any notice. If it is found that a User is engaging in Games on our Platform via an IP address of any Restricted Territory(ies), such Users Account(s) will be terminated with immediate effect. Such User shall keep the Company, its affiliates, officers, representatives and agents fully indemnified from such misrepresentation. You accept that the Company will not be liable to take any responsibility for the breach of the User of Applicable Laws. Users from all jurisdictions have to always ensure that they are following the Applicable Laws. Our decision in this regard will be final, and no consideration whatsoever will be extended to the User.

USAGE OF THE SERVICES

GetZapped reserves the right, but is under no obligation, to monitor, review, pre-screen, edit, remove, or disable access to any User content at its sole discretion allows You to play the free to play game of Poker through Our Platforms.
All Existing User account data/information previously stored and accessed to by Baazi Networks Private Limited on the ‘PokerBaazi’ application and website shall be transferred to the Platform and shall be accessed by the Company for the provision of Services. The Existing User’s hereby acknowledge the same.
When You access the Services and/or create an Account on the Platform, We may collect, use, share with third parties, store, or otherwise process Your information, which may include Your personal information and sensitive personal information, to ensure that the Services may be accessed and used by You efficiently. The collection, use, sharing of such information is governed by the Privacy Policy which forms an integral part of the Platform Policies. You may access the Privacy Policy here.
You are required to verify Your mobile number at the time of registration on the Platform. All Your information is kept confidential and processed as per Our Privacy Policy.
We reserve the right, at our sole discretion, to modify, update, or amend any aspect of the Services at any time by providing You with a notice of the same. These changes may be made to ensure compliance with regulatory requirements, enhance user experience, and support the efficient operation of the platform.
When You register with Us, You agree to receive promotional and service messages from Us, and our affiliates, through SMS, email, call and push notifications. You may withdraw Your consent to receive such communications by sending an email to grievance.officer@pokerbaazi.net.
Internet connectivity issues at Your end, disruptions due to Your local internet environment, errors in the setup of software or hardware of Your device, or other factors not directly attributable to Us, are beyond Our control, and accordingly, You agree that We will not incur any liability for any halts, breaks, or interruptions in Your usage of Our Services on account of such issues.
You understand and acknowledge that once a game/tournament has commenced, not being able to play due to slow internet connections, faulty hardware, internet connection failure, low computer configuration or for some other reason are not attributable to the Company. You are solely and entirely responsible for such impairments.
You agree not to post any offensive, obnoxious, indecent or unsolicited content on the Platform including but not limited to any advertisement, promotional material, Your personal information or such other details. In the event of such posting, You shall keep the Company/Platform indemnified from and against all direct and indirect damage/loss resulting therefrom.

USER REGISTRATION

When You register with Us, You are required to choose a username which shall be your identity (“User ID”) on the Platform. Your chosen username is confirmed subject to it being in compliance with these Terms and novelty.
You are prohibited from creating or using multiple accounts on Our Platform. If We detect multiple accounts belonging to a single User, We may take penal action and/ or suspension of the linked accounts.
User IDs must not be indecent, objectionable, offensive, or unlawful. User IDs that are found to violate the intellectual property of any entity, reveal personal information, or be suggestive of an advertising or promotional activity, may be rejected.
Your User ID will remain active on the Platform unless We terminate or suspend Your access to the Platform for a violation of the Platform Policies in accordance with these Terms, or Your User Account becomes inactive in accordance with the Termination and Suspension clause provided herein.
You may only have one account on Our Platform (“Account”), for which You will need to register using Your own, correct name with valid credentials and declaration of age, as sought at the time of registration. You may not share Your Account with any other User or person nor use the service by means of another Users Account. Should You attempt to open more than one Account, under Your own name or under any other name, or should You attempt to use the Service by means of any other Users Account, We will be entitled to close all Your Accounts and bar You from using the Services. You should ensure that you have read and understood the rules and regulations of the Games. You agree to abide by the rules and regulations of each of the Games as published and periodically changed on the Platform. You agree to keep yourself updated in respect of the rules and regulations, which are subject to change from time to time, at the sole discretion of the Company. The rules that govern the Games offered on the Platform form part of the Terms and they will be available under the Game Rules or similar section on the Platform. However, if any rules are not explicitly mentioned on the Platform, the User is encouraged to seek clarification by using the customer support services offered. The interpretation/decision of the Company will be final, and You agree to abide by them by accepting these Terms.
Sharing or distribution of the password with any other User/ person/ group or any third party is strictly prohibited. The Company is not responsible if Your Account is accessed or opened by others using Your password. You are held legally responsible and liable for all of Your activities on the Platform made from your Account, whether or not made by You.

MEMBERSHIP – BAAZI SELECT

Users may subscribe to “Baazi Select”, a paid membership or subscription program (“Membership”), through the payment methods through in-app purchases on the User’s relevant app Store . All payments for the Membership are final and non-refundable, except as required by applicable law, governed in light of these Terms as specified at the time of purchase.
The Membership, provides enhanced features, including:
1. Exclusive access to Table Themes and Card Themes;
2. Exclusive Avatars, Emojis, and Throwables;
3. Access to Poker TV content;
4. Higher-value rewards within the Reward Store;
5. HUD Statistics on the game table for opponents;
6. An ad-free experience (as may be rolled out in phases);
7. Other premium features introduced from time to time.
Subscription billing, renewals, cancellations, and refunds shall be governed exclusively by the User’s relevant app store’s billing policy. ..
The Membership may provide enhanced access and benefits within the Platform. The Membership, in no manner alters the recreational and entertainment-only nature of the Services. Furthermore, it is explicitly clarified that subscribing to Membership does not, in any form or manner whatsoever, result in online money gaming under the provisions of the Promotion and Regulation of Online Gaming Act, 2025 or any other applicable state law in India.
Users are responsible for any applicable taxes, duties, or levies associated with the Membership.
The Company does not process, store, or have access to Users’ payment card details.
Any data obtained from the User in furtherance of the Membership shall be governed by the by these Terms and the Privacy Policy wherever applicable. However, any data given to third parties shall be governed by the privacy policy of such third party and the Platform shall not be responsible for such information/data.
GetZapped reserves the right, at its sole discretion, to modify the fees and benefits of the Membership at any time and Your continued use after such modifications shall constitute acceptance of the revised terms.

RESTRICTION ON USE OF SERVICES

GetZapped reserves the right, but is under no obligation, to monitor, review, pre-screen, edit, remove, or disable access to any User Content at its sole discretion. You shall not upload, distribute, transmit, publish, share, display, or post any content through Our Services including any communication feature, provided by Us which:
- belongs to another User and to which You do not have any right;
- is defamatory, obscene, pornographic, paedophilic, invasive of another’s privacy, including bodily privacy, insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force;
- is harmful to a minor under the age of 18 (eighteen);
- infringes any patent, trademark, copyright or other proprietary rights;
- deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;
- impersonates another User or person;
- threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other nation;
- contains a software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
- is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a User or person, entity or agency for financial gain or to cause any injury to any User or person;
- is otherwise objectionable or undesirable (whether or not unlawful);
- is aimed at soliciting donations, chips or other forms of help;
- disparages GetZapped or any of its subsidiaries, affiliates, licensors, associates, partners, sponsors, products, services, or Platforms, in any manner;
- promotes a competing service or product; or
- violates any Applicable Laws.
You shall not use the Services for commercial purposes, including but not limited to use in a cyber cafe as a computer gaming centre, network play over the Internet, or through gaming networks, or connection to an unauthorized server that copies the gaming experience offered by Us.
You shall not purchase, sell, trade, rent, lease, license, grant a security interest in, or transfer Your Account, content, Reward Points, standings, rankings, ratings, or any other attributes appearing in, originating from, or associated with the Services.
You undertake that You will not permit any other User or person to access or use Your Account and You will not use any form of external assistance to play the Games or indulge in any activity which violates the Platform Policies.
You shall not send spam emails to any other User on the Platform, or any other form of unsolicited communication for any other purpose.
Your Reward Points from the successful participation and placement on the Leaderboard in the Services and ranking in the free-to-play tournaments organised by the Company may be disclosed to the relevant authorities, in order to ensure compliance with Applicable Laws and lawful requests from the Government, Regulatory authorities, or an order of any Court of competent jurisdiction.
The Users admit that they may be exposed to content posted by other Users, which they may find offensive, obnoxious or indecent and that the Platform may not be able to prevent such content being posted and You agree that You shall not hold the Company liable or responsible for such content in any manner. Such content should be brought to the notice of the Company. The Company shall act upon the information as it deems acceptable. The decision taken by the management of the Company or the Platform in this regard shall be final and binding on the User and the User specifically agrees the Company will not incur any liability under any circumstance whatsoever regarding the same. You understand that it is Your obligation to protect the information You have provided on the Platform including, but not limited, to usernames, passwords, email addresses, contact details, and telephone numbers.

PROHIBITED CONDUCT

Users are strictly prohibited from engaging in any activity that undermines the integrity, security, fairness, or lawful operation of the Platform; interferes with the Platform’s compliance of Applicable Laws or its internal governance and operational policies, including Platform Policies; or affects the safety and interests of other Users on the Platform. Without limitation and in addition to any other unlawful conduct highlighted in these Terms or other Platform Policies, the following actions constitute Prohibited Conduct and shall be deemed a material breach of these Terms:
- Engaging in, facilitating, or promoting any form of online money games, real-money gambling, wagering, or betting (including any attempt thereof), through, within, or in connection with the Platform or its Services (including its features), directly or indirectly. If You are found using or attempting use of any Platform Services or features to facilitate, engage or permit or cause to permit any such prohibited activity, strict action will be taken against You.
- Selling, bartering, exchanging, or otherwise transferring Play Chips, Reward Points, in-app credits, or User accounts for real-world currency, goods, or services, whether directly or through third-party intermediaries or in any manner inducing or facilitating other Users to do so. The Platform strictly prohibits any attempt to transfer, gift, buy, sell, trade or exchange any Play Chips or Reward Points or any anything of real-world value or inducing, promoting or facilitating thereof. The Platform does not recognize, validate, or accept responsibility for any such external transactions or their consequences. You are not allowed to sublicense, trade, sell, or attempt to sell such Play Chips or Reward Points for real money, or exchange the same for any real-world value outside the Platform. Any such transfer/arrangement or attempt thereof is prohibited and void, and we are entitled to terminate Your Account and take legal action against You.

CUSTOMER VERIFICATION

The Company may at any point conduct relevant customer verification through those process (“Customer Verification”) which it may deem required. In light of the same, Users shall be required to submit documents as may be deemed necessary by the Company.

TAXES

As the Services, Games, tournaments are free-to-play, no tax shall be applicable on participation.
In cases where Users purchase the Membership offered by the Platform, the purchase of the Membership shall be subject to the requisite taxes under Applicable Laws.
The Company shall, where required, deduct tax at source (“TDS”) in accordance with the provisions of the Income-tax Act, 1961, or any other Applicable Laws with respect to the redemption of Reward Points by Users. The Company shall issue a TDS certificate to such User in the event the same is expressly requested for by the User.
The User shall be solely responsible for reporting such income in their tax filings, if applicable.

SUSPENSION AND TERMINATION

We reserve the right to suspend or terminate Your Account if We find that You are violating any of Our Platform Policies, or breaching/attempting to breach the security of Our Services in any manner.
In the event Your Account is terminated by Us in accordance with the above-mentioned clause, You will not be permitted to use Our Services thereafter using the mobile number, proof of address, proof of identity, or other details linked to the terminated Account; and
If We find that a User is breaching/attempting to breach Our security or privacy protocols, We may, following an internal investigation, decide to undertake a range of remedial actions, depending upon the severity of the detected breach, which may include the following:
- stop access and usage of Our Services, indefinitely, by such User;
- permanently terminate such User’s Account;
- demand compensation for the damages to Our Services that occurred because of the breach and prosecute the User for any violation of the law and the Platform Policies if need be; and
- prohibit the User from registering with Us in the future and cancel all previous transactions.
We shall have the right to investigate and monitor Your Account and Your gameplay for such period of time as in Our reasonable opinion may be needed to investigate such breach which shall not be for a period of 180 days from the date of notification of such breach. Such investigation will cover all the Games that the concerned User has played since the time of registering on the Platform.
We reserve the right to suspend Your Account or block the Account in Our sole discretion upon instruction or being made aware of a cyber fraud or any other fraudulent activity related to a User’s Account by a governmental, police or any law enforcement authority or agency.
You are free to discontinue using Our Services at any time by sending Us an email indicating such intention at grievance.officer@pokerbaazi.net. (“Discontinuation Request”)..
Where Your access to Your Account is limited or access to the Services is restricted as a result of unsuccessful Account validation, We may take seven (7) working days to reinstate complete access to Your Account and the Services upon successful validation. In the event that We have made several unsuccessful attempts to reach out to You, We reserve the right to terminate Account. We will not be liable for any claim, damage or loss accruing to You from such termination or restriction.

REPRESENTATION AND WARRANTIES

You represent that:

You are eligible and competent to access and use the Services offered by GetZapped.
Any information You provide to Us at any time during the access and use of the Services, whether at the stage of registration or any time thereafter is correct, complete, up-to-date, and accurate. We shall not be liable against any claim relating to the accuracy, completeness, and correctness of any information You provide Us. We may, at any time and at Our sole discretion, require You to verify the correctness, completeness, and accuracy of such information, and to that extent require You to produce additional documentary proof. Where You fail to provide Us with valid documentary proof, We reserve the right to limit Your access and use of Our Services.
You will protect the information You provide Us, including Your password used to avail of Our Services. We will never require You to enter or disclose Your Account password, except at the time of logging on to the Platform. You must never share Your Account login information with anyone, including any other User of the Platform or any representative of GetZapped. You specifically understand and agree that We will not incur any liability for information provided by You to anyone which may result in Your Account being exposed or misused by any other User or person.
You shall use Your Account solely for the purpose of playing the Games offered through Our Services, and the Services shall not be used to launder funds or commit any other unlawful or prohibited activity.
You have the experience, and the requisite skills required to play Games on the Platform, and that You are not aware of any physical or mental condition that would impair Your capability to fully participate in such activity.
You understand and accept that Your participation in a Game does not create any obligation on Us to give You Reward Points. Your winning a Reward Points is entirely dependent on the outcome of the Game and Your ranking at the end of a free-to-play game/tournament basis your skill vis-à-vis other Users in the Game and is further subject to the Platform Policies.
GetZapped is not responsible for Your inability to access or play any Game or event in which You may be eligible to participate, irrespective of the cause of such event. This includes situations where You are unable to log into Your Account or the same may be pending validation or You may be in suspected or established violation of any of the Platform Policy.
You will not attempt to use the Platform in any manner, directly or indirectly, to aid, abet, facilitate, engage or induce other Users to engage in any external exchange, transfer, or misuse any Platform Service.

CONTENT

We may place certain promoted or sponsored content on the Platform (directly or via links to other websites or resources) in conjunction with third parties. We make no warranties with respect to such content and neither do We endorse any information contained therein. We shall not be liable to You for such promoted or sponsored content, and Your interaction with such content or third-party resources shall be solely at Your own risk.
We may use any content in relation to the Games played on the Platform, including recordings of the gameplay, for Our corporate and marketing purposes, and accordingly, You acknowledge, agree, and consent to Our right in this regard.

LIMITATION OF LIABILITY AND INDEMNITY

You agree to indemnify and hold harmless GetZapped against any claims, actions, suits, damages, penalties, or awards brought against Us by any entity or individual in connection with or in respect of Your use of the Services.
The Platform is offered by GetZapped on an as-is basis and GetZapped makes no implied warranties, with respect to the Service. All implied warranties of merchantability and fitness for a particular purpose or use, are disclaimed. No one is authorized to make any warranty on Our behalf, and Users may not rely on any other statement of warranty. However, where we receive adequate notice of an error in the Services, We shall take prompt steps to rectify the same.
GetZapped expressly disclaims all responsibility and liability for any harm, damages, or loss resulting from Your participation in, or cancellation of, any Game, any activity and any User-generated content, including any violation of intellectual property rights with respect to such User-generated content.
A failure by Us, to insist upon strict performance of any of the provisions herein or to exercise any option, right or remedy contained herein, shall not be construed as waiver or relinquishment of such provisions, option, right or remedy. No waiver of any provision hereof shall be deemed to have been made unless expressed in writing and signed.
The latest versions of the Platform Policies, as published on the Platform, contain the entire agreement between You and Us regarding the access to and use of the Services and supersedes all prior agreements, including prior versions of the Platform Policies.
You are accountable to obey any Applicable Law, while taking part in any Games or tournament organized through the Platform. You undertake and agree to assure us against any claims, expenses or liabilities suffered by or claimed against us by any person or entity arising out of your non-compliance with any Applicable Laws and/or resulting from any activity through your Account.

COMPLAINTS AND DISPUTES

GRIEVANCE OFFICER
- If You have any complaint or grievance relating to any aspect of the Services, You may approach Our customer care and grievance redressal team for the resolution of such issues by writing to grievance.officer@pokerbaazi.net.
- You agree that all complaints and disputes at GetZapped are to be kept confidential. We will endeavour to resolve all grievances within a reasonable period, as mandated under Applicable Laws. Any decision taken by Us relating to any complaint will be binding on the User.

- The aforementioned Grievance Officer has been appointed in light of the Applicable Laws, including but not limited to the Promotion and Regulation of Online Gaming Act, (2025), Information and Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 enacted thereunder.
- You agree that the Grievance Officer can be replaced by us at Our sole discretion through the publication of such replacement on Our Platform.
- If a User is dissatisfied with the resolution provided by the Grievance Officer and the Company or receives no response within a specified time period, they may appeal to the Grievance Appellate Committee established under the under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 within thirty (30) days as prescribed.

GOVERNING LAW, DISPUTE RESOLUTION, AND JURISDICTION

For Indian Users

The Platform Policies are governed by and shall be interpreted in accordance with the laws of India.
Subject to the arbitration clause mentioned hereinbelow, any dispute, controversy, or claim against the Us or arising out of these Platform Policies shall be subject to the exclusive jurisdiction of the civil courts at New Delhi, India.
In the event of any legal dispute arising in relation to any aspect of the Platform Policies, or the use of our Services by You, You must provide written notification to Us of the dispute and relevant details. We shall attempt to resolve the dispute through discussions with You, and where such resolution fails to be concluded within thirty (30) days, the dispute may be referred to arbitration. The arbitration shall be conducted before a tribunal of three (3) arbitrators wherein both GetZapped and You shall be entitled to appoint one (1) arbitrator each and the two (2) arbitrators shall jointly appoint the third arbitrator. The place of arbitration shall be New Delhi, India, and the arbitration proceedings shall be conducted, in English, in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The award arising from such arbitration proceedings will be final and binding on the parties, and each party will bear its own costs of arbitration and equally share the fees of the arbitrator unless the arbitral tribunal decides otherwise.
Notwithstanding anything in the Arbitration clause hereinabove, GetZapped shall be entitled to seek and obtain from a court of competent jurisdiction, an interim or permanent equitable or injunctive relief, or any other relief available under Applicable Laws, to safeguard its interest, at any time during the pendency of a dispute with You or any other person, and such pursuit of relief shall not constitute a waiver of the arbitration process mandated herein.

For Non-Indian Users

The Platform Policies are governed by and shall be interpreted in accordance with the laws of England and Wales.
Subject to the arbitration clause mentioned hereinbelow, any dispute, controversy, or claim against the Us or arising out of these Platform Policies shall be subject to the exclusive jurisdiction of the civil courts at London.
In the event of any legal dispute arising in relation to any aspect of the Platform Policies, or the use of our Services by You, You must provide written notification to Us of the dispute and relevant details. We shall attempt to resolve the dispute through discussions with You, and where such resolution fails to be concluded within thirty (30) days, the dispute may be referred to arbitration. final and binding arbitration under the Rules of the London Court of International Arbitration (“LCIA”), by a sole arbitrator appointed in accordance with such Rules. The seat and venue of arbitration shall be London, United Kingdom, and the proceedings shall be conducted in English. The arbitral award shall be final and binding upon both parties and enforceable in any court of competent jurisdiction. Each party will bear its own costs of arbitration and equally share the fees of the arbitrator unless the arbitral tribunal decides otherwise.

UNFAIR GAMEPLAY:

We, at GetZapped, will always consider the best interests and fairness of the game. Game manipulation/Unfair Gameplay shall not be tolerated, and We shall take all suitable measures and/or actions against Users/accounts engaging in such game manipulation or illegal activity or unfair gameplay.
Cases of any game manipulation or unfair gameplay or illegal activities including but not limited to chip dumping, collusion, soft play, chat abuse, misuse of chat for discussing hands, multiple accounts, use of EPA Programs, use of BOTS etc. shall be strictly dealt with by Us in the following manner:
1. CHIP DUMPING
  1. Chip-dumping occurs when any User intentionally loses a hand in order to deliberately transfer his/her Chips to any other User.
  2. We consider the illegal activity of Chip dumping as a material breach of these Terms and accordingly we shall have the right to take appropriate action against the Users, involved in illegal activity of Chip dumping, as we deem fit on case-to-case basis.
  3. In the event we, at GetZapped, find that the User is involved in such illegal and unfair activity of Chip Dumping in any way possible on the Platform, we shall be entitled to take any of the actions as we deem fit on a case-to-case basis, including but not limited to:
    - Immediately blocking access to the Platform of all the Users involved in illegal activity of Chip Dumping and not allowing them to continue in any running tournament that they are playing and/or are registered in any tournaments in future on the Platform.
    - Termination/closure of Account of all the Users involved in illegal activity of Chip Dumping.
    - Taking appropriate legal action against all the User (involved in illegal activity of Chip Dumping) under Applicable Law in the jurisdiction.
1. COLLUSION
  1. Any User found to be intentionally doing soft play against his/her opponent or knowing other User’s card even before the particular hand goes to showdown or Users working together is accounted for collusion.
  2. Collusion between Users by sharing whole cards or by any other methods is strictly forbidden. We reserve the right, in addition to other measures, to restrict and/or to prohibit Users from playing at a particular game or in a tournament, including restricting two or more Users from playing together in the same game or tournament.
  3. When the User agrees to the Terms, he/she agrees that he/she shall not play any game in partnership or by communicating with other Users which may give benefit to him/her over other Users. We consider any collusion between Users as a material breach of these Terms and accordingly we shall have the right to take appropriate action against the Users, involved in illegal activity of Collusion, as we deem fit on case-to-case basis.
  4. In the event we, at GetZapped, find that the User is involved in such illegal and unfair activity of Collusion in any way possible on the Platform, we shall be entitled to take any of the actions as we deem fit on a case-to-case basis, including but not limited to:
    - Immediately blocking access to the Platform of all the Users involved in illegal activity of Collusion and not allowing them to continue in any running tournament that they are playing and/or are registered in any game/tournaments in future on the Platform.
    - Termination/closure of Account of all the Users involved in illegal activity of Collusion.
    - Taking appropriate legal action against the Users (involved in illegal activity of Collusion) under Applicable Laws in the jurisdiction.
1. MULTIPLE USER ACCOUNTS
  1. It is prohibited for a User to open multiple Accounts on the Platform. A User may only have one Account and shall only use the Platform using such single account A User is also prohibited from creating any User account on the Platform in his/her family member’s and/or friend’s and/or relatives’ name and/or playing Games from any other User Account (including but not limited to family or friends or relatives’ accounts) on the Platform. Further, a User shall be strictly prohibited from allowing any other person to access his/her User account for playing Games on the Platform. Users shall be strictly restricted or prohibited from using any User account on a sharing basis on the Platform. (“Multiple Accounts”)
  2. We consider Multiple Accounts of a User as a material breach of these Terms and accordingly we shall have the right to take appropriate action against the User, involved in such illegal activity of Multiple Accounts (Multiple User Accounts) on the Platform, as we deem fit on case-to-case basis.
  3. In the event, that we, at GetZapped, become aware of additional accounts (Multiple Accounts) opened by a User, we shall be entitled to take any of the actions as we deem fit on a case-to-case basis, including but not limited to:
    - Immediately blocking access to the Platform of all the Users involved in illegal activity of operating Multiple Accounts and not allowing them to continue in any running tournament that they are playing and/or are registered in any game/ tournaments in future on the Platform.
    - Termination/closure of Account of all the Users involved in illegal activity of operating Multiple Accounts.
    - Taking appropriate legal action against the Users (involved in illegal activity of operating Multiple Accounts) under Applicable Laws in the jurisdiction.
1. IP GHOSTING
  1. User, during the gameplay on the Platform, shall not and/or attempt to change the Internet Protocol (IP) Address and/or Geo-location multiple times without written authorization from GetZapped (“IP Ghosting”).
  2. We consider illegal activity of IP Ghosting by a User as a material breach of these Terms and accordingly we shall have the right to take appropriate action against the User, involved in such illegal activity of IP Ghosting on the Platform, as we deem fit on case-to-case basis.
  3. In the event we, at GetZapped, find that the User is involved in such IP Ghosting and/or change of Geo-location during gameplay on the Platform, we shall be entitled to take any of the actions as we deem fit on a case-to-case basis, including but not limited to:
    - Immediately blocking access to the Platform of all the Users involved in illegal activity of IP Ghosting and not allowing them to continue in any running tournament that they are playing and/or are registered in any game/tournaments in future on the Platform.
    - Termination/closure of the Account of all the Users involved in illegal activity of IP Ghosting.
    - Taking appropriate legal action against the Users (involved in illegal activity of IP Ghosting) under Applicable Laws in the jurisdiction.
1. SOFTWARE MODIFICATIONS
  1. User shall not and/or attempt to modify, decompile, reverse-engineer or disassemble the GetZapped Software in any way.
  2. We consider illegal activity of software modification by a User as a material breach of these Terms and accordingly we shall have the right to take appropriate action against the User, involved in such illegal activity of software modification on the Platform, as we deem fit on case-to-case basis.
  3. In the event we, at GetZapped, find that the User is involved in such software modification or has attempted to modify GetZapped software in any way possible, we shall be entitled to take any of the actions as we deem fit on a case-to-case basis, including but not limited to:
    - Immediately blocking access to the Platform of all the Users involved in illegal activity of Software Modification and not allowing them to continue in any running tournament that they are playing and/or are registered in any game/tournaments in future on the Platform.
    - Termination/closure of the Account of all the Users involved in illegal activity of Software Modification.
    - Taking appropriate legal action against the Users involved in illegal activity of intellectual property infringement under Applicable Laws in the jurisdiction.
1. EXTERNAL PLAYER ASSISTANCE PROGRAMS AND BOTS
  1. The use of artificial intelligence including, without limitation, 'robots' is strictly forbidden on the Platform. All actions taken in relation to the Platform by a User must be executed personally by the said User through the User interface accessible by use of GetZapped Software.
  2. We prohibit those External Player Assistance Programs which are designed to provide an 'Unfair Advantage' to Users. We define 'External' to mean computer software (other than the GetZapped Software), and non-software-based databases or profiles. We define an Unfair Advantage as any instance in which a User accesses or compiles information on other Users beyond that which the User has personally observed through the User's own game play.
  3. The User agrees that we, at GetZapped, may take steps to detect and prevent the use of prohibited External Player Assistance (EPA) Programs. These steps may include, but are not limited to, examination of software programs running concurrently with Our Software on the User's PC or Device. The User agrees that they will not attempt to bypass, interfere with, or block such steps, including, without limitation, the use of third-party software that bypasses, interferes with, or blocks such steps.
  4. We consider this illegal activity of using EPA Programs and BOTS as a material breach of these Terms and accordingly we shall have the right to take appropriate action against the User, involved in such illegal activity of using EPA Programs and BOTS on the Platform, as we deem fit on case to case basis.
  5. In the event we, at GetZapped, find that the User is involved in such illegal activity of EPA Programs and/or use of BOTS, we shall be entitled to take any of the actions as we deem fit on a case-to-case basis, including but not limited to:
    - Immediately blocking access to the Platform of all the Users involved in illegal activity of using EPA Programs and BOTS and not allowing them to continue in any running tournament that they are playing and/or are registered in any Games/tournaments in future on the Platform.
    - Termination/closure of Account of all the Users involved in illegal activity of using EPA Programs and BOTS.
    - Taking appropriate legal action against the Users involved in illegal activity of using EPA Programs and BOTS under Applicable Laws in the jurisdiction.
1. OFFENSIVE LANGUAGE OR CONTENT
  1. The User is prohibited from posting any unlawful, indecent, racist, religious, obscene, libellous, defamatory or threatening material or any material that would violate any Applicable Laws or generally be considered to be offensive, via the Platform whether using the chat function, or in correspondence/conversation with Our personnel.
  2. We consider illegal activity of using offensive language or content by a User as a material breach of these Terms and accordingly we shall have the right to take appropriate action against the User, involved in such illegal activity of using offensive language or content by a User on the Platform, as we deem fit on case-to-case basis.
  3. In the event we, at GetZapped, find that the User is involved in such illegal activity of using offensive language or content, we shall be entitled to take any of the actions as we deem fit on a case-to-case basis, including but not limited to:
    - Warning to the said User and temporary blocking for the time period decided by GetZapped at its sole discretion.
    - Immediately blocking access to the Platform of all the Users involved in illegal activity of using offensive language or content and not allowing them to continue in any running tournament that they are playing and/or are registered in any Games/tournaments in future on the Platform.
    - Termination/closure of Account of all the Users involved in illegal activity of using offensive language or content.
    - Taking appropriate legal action against the Users involved in illegal activity of using offensive language or content under Applicable Laws in the jurisdiction.
      - Immediately blocking access to the Platform of all the Users involved in illegal activity of being a disguised User and not allowing them to continue in any running Game/tournament that they are playing and/or are registered in any tournaments in future on the Platform.
      - Termination/closure of Account of all the Users involved in illegal activity of being a disguised User.
      - Taking appropriate legal action against the Users involved in illegal activity of being a disguised User under Applicable Laws in the jurisdiction.
1. DISGUISED USER AND FAILED TELEPHONE VERIFICATION
  1. The User shall not disguise himself/herself to be another User and play Games on the Platform. GetZapped verifies all the details/information and documents of each User uploaded on the Platform by each User including but not limited to registered contact details, verification documents (as required by the Platform at the time of withdrawal).
  2. GetZapped shall verify all the said details/information and documents from each User through a telephonic conversation. The answers by the Users shall be assessed by GetZapped and if the User is found providing wrong answers and/or is unable to answer the questions (through such telephonic conversation) posed by GetZapped pertaining to the said details/information and documents uploaded by him/her on the Platform, we shall be entitled to take any of the following actions as we deem fit on a case to case basis, including but not limited to:
1. FRAUDULENT BEHAVIOUR
  1. In the event that we, at GetZapped, deem that a User has engaged or attempted to engage in fraudulent, unlawful, dishonest or improper activity while using the Platform, including without limitation, engaging in any of the activities set forth above or any other game manipulation, We, at GetZapped, shall be entitled to take such action as we deem fit, including but not limited to:
    - Immediately blocking a User’s access to the Platform including but not limited to not allowing them to continue in any running tournament that they are playing and/or are registered in any Game/tournaments in future on the Platform.
    - Terminating a User's Account.
    - Taking appropriate legal action against a User under Applicable Laws in the jurisdiction.
In any such cases of unfair and illegal activities (including but not limited to chip dumping, collusion, soft play, chat abuse, misuse of chat for discussing hands, multiple accounts, use of bots), User IDs shall be investigated by the Company can take up to seven (7) working days before a decision on the same is communicated to the User. User shall render all cooperation required by the Company in order to carry out such investigation.
Post the investigation, any decision taken by the Company shall not be disputed by the User and the decision shall be considered final and binding. User agrees that no further queries shall be entertained post the final decision.
